A.1

The following Terms of Service for the service made available by DocRevolution from the website www.ipidcreator.eu made available by DocRevolution for public use (collectively the "DocRevolution IPIDcreator") is a legal contract between you, an individual of at least 18 years of age, or a single legal entity ("You" or collectively the "User"), and DocRevolution (“DocRevolution”) regarding your use of the DocRevolution IPIDcreator (the "Terms").

A.2

As used in these Terms: the "Publications" means digital content uploaded and published on the DocRevolution IPIDcreator in a format supported by the DocRevolution IPIDcreator as decided by you, including but not limited to any embedded content in other formats (including film and video formats) and links to external content.

A.3

Any upload of a Publication to the DocRevolution IPIDcreator will by default be made public worldwide.

A.4

You should not use the DocRevolution IPIDcreator if you do not want to have your Publications be made public worldwide.

B.1

The DocRevolution IPIDcreator is not available to persons under the age of 18 or to any users previously removed from the DocRevolution IPIDcreator by DocRevolution.

B.2

Furthermore, the DocRevolution IPIDcreator is only available to professionals, so you need to be able to provide the required information to open an account with us.

C.1

By checking the "i accept the terms of service" button, you assent to and agree to be bound by these terms and represent that you act in your capacity as a professional, are at least the age of majority in your jurisdiction and have not been previously removed from the DocRevolution IPIDcreator.

C.2

If you are using or opening an account with docrevolution on behalf of a company, entity, or organization (collectively a "subscribing organization") then you represent and warrant that you are an authorized representative of that subscribing organization with the authority to bind such organization to these terms and agree to these terms on behalf of such subscribing organization in accordance with the undertaking in section C.1.

C.3

You are obliged to observe and comply with any privacy regulations that apply to your Publications and the display and use of the Publications for which you are responsible.

C.4

You are solely responsible for complying with European or national legislation regarding the Insurance product information document (IPID) under the Insurance Distribution Directive (IDD). By publishing IPID documents via DocRevolution IPIDcreator you acknowledge this responsibility.

C.5

DocRevolution does not guarantee the digital accessibility of publications created with IPIDcreator. A version of the IPID HTML template and representative content from IPIDcreator have been tested by DocRevolution for Digital Accessibility according to the best practice principle. Digital accessibility is partly based on the content that you place. We advise you to adhere to the instructions we provide for this. You are solely responsible for complying with European and/or national legislation regarding digital accessibility. DocRevolution can facilitate, upon request and at an additional cost, to have your IPID documents tested by an official agency.

C.6

DocRevolution has the right to make changes to Publication templates in DocRevolution IPIDcreator, for example with regard to digital accessibility or legislation. You are responsible for removing existing Publications and republishing them to effectuate the changes in Publication templates. We will inform you via the system if such changes occur.

D.1

When accepting the Terms, you accept that DocRevolution sends you service notifications within the DocRevolution IPIDcreator, including but not limited to notifications of the need for you to upgrade your subscription plan if you want to use specific features not included in your current subscription plan. In your account settings you can decline to receive future notifications. You can unsubscribe from these notifications at any time by clicking the link in any email we send,

We reserve the right, at our discretion, to change, modify, add or remove portions of these Terms on a going-forward basis at any time by posting the amended Terms on our website for acceptance next time you log in to your account.

1.1

We will highlight and explain any changes, modifications, additions or removals that we believe are of importance to our contractual relationship

E.2

Unless we state a longer notice period, changes are effective fifteen (15) days following the date when you accept the new Terms. Once accepted, the new Terms will be accessible under your account information and will also be sent to you by email. Any upload of new Publications during the notice period will also be considered an acceptance of the new Terms.

E.3

If you do not want to accept the changes, you may terminate your Subscription at any time by closing down your account.

E.4

Such changes may include, but not be limited to changes to the amount of storage space you have on the DocRevolution IPIDcreator at any time, the features included in a subscription plan or the technical requirements for the use of the DocRevolution IPIDcreator.

E.5

DocRevolution may introduce new ways of display, transfer, reproduce, change or distribute your content without asking you for permission as you accept that your only remedy is to revoke your license. DocRevolution may on the other hand decide that your use of new functionality shall be subject to payment of a fee (Paid Service), in which instance any use of the new functionality and thereby use of your uploaded content is subject to your acceptance and payment of applicable fee.

E.6

We may also change or discontinue the DocRevolution IPIDcreator in whole or in part at any time at our sole discretion, again giving you at least thirty (30) days written notice unless the change of the DocRevolution IPIDcreator stems from legal or regulatory obligations incumbent on DocRevolution under the national law that you as a User are subject to, or the national regulations that we are subject to.

E.7

If DocRevolution discontinues a Paid Service (as defined below), or you choose to terminate your Paid Service due to changed terms, DocRevolution may either

  1. provide a pro rata refund of fees that you have prepaid for such Paid Service, or
  2. continue to provide such Paid Service to you until the end of your current subscription for such Paid Service regulated by the unchanged terms.
F.1

By creating Publications with the DocRevolution IPIDcreator in a format supported by DocRevolution, you hereby accept that your Publication will be made public worldwide and distributed to the DocRevolution users and an unknown internet audience.

1.1

DocRevolution may introduce features that will allow you and DocRevolution to decide where a Publication is made public.

F.2

By publishing your Publication with the DocRevolution IPIDcreator, you hereby grant to DocRevolution a worldwide, non-exclusive, transferable, assignable, fully paid-up, royalty-free license to host, transfer, display, perform, reproduce, distribute, and otherwise use your Publication to operate the DocRevolution IPIDcreator in accordance with these Terms and your paid plan. This license also includes the right for DocRevolution to display and make your Publication available, in whole or in part (including excerpts), on the DocRevolution IPIDcreator in association with other Publications or online advertising. The license granted by you to DocRevolution in this section terminates as to a specific Publication once you remove or delete such Publication from the DocRevolution Publication Service.

F.3

You are solely responsible for all of your created and published Publications, including the legality of any contained advertisement, and you hereby recognize and affirm that the DocRevolution IPIDcreator is merely providing you the means to collaborate on and make available your Publications. Accordingly, you shall be solely responsible for each of your Publications and the consequences of uploading them.

F.4

By publishing your Publications, you affirm, represent, and warrant that:

4.1

You are the creator and owner of or have the necessary licenses, rights, consents, and permissions to use and to authorize DocRevolution and DocRevolution's Users to use and distribute your Publications as necessary to operate the DocRevolution IPIDcreator and exercise the licenses granted by you in this section and in the manner contemplated by DocRevolution, its Users and these Terms;

4.2

Your Publications do not and will not:

  1. infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right, or
  2. slander, defame, libel, or invade the right of privacy, publicity or other property rights of any other person; and
  3. your Publications do not contain any viruses, adware, spyware, worms, or other malicious code or any content or file that provides a method to access to potentially infringing content outside of the DocRevolution IPIDcreator. Violators of these third-party rights may be subject to criminal and civil liability.
4.3

DocRevolution reserves all rights and remedies against any Users who violate this section of the Terms.

4.4

DocRevolution has the right to remove Publications created in or publish with the DocRevolution IPIDcreator.

F.5

After termination of the Subscription, the right to use and make publicly available Publications created with the Software ends.

G.1

You agree not to commit any act of the following prohibited conduct:

1.1

use the DocRevolution IPIDcreator for any purpose other than to upload original or appropriately licensed content and to access the DocRevolution IPIDcreator as such services are offered by DocRevolution;

1.2

not to operate more than one account unless you have obtained the prior written permission from DocRevolution to have more than one active account per natural person or legal entity;

1.3

not to upload and publish any Publications intended for children without having made a clear declaration that the Publication is intended for children;

1.4

delete the copyright or other proprietary rights markings on the DocRevolution IPIDcreator or other Users’ publications;

1.5

make unsolicited offers, advertisements, proposals, or send junk mail or spam to users of the DocRevolution Service. This includes, but is not limited to unsolicited advertising, promotional materials, or other solicitation material, bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures;

1.6

use the DocRevolution IPIDcreator in violation of any local, state, national, or international law, including, without limitation, laws governing intellectual property and other proprietary rights, and data protection and privacy or post, upload, or distribute any defamatory, libelous, or inaccurate Publications;

1.7

defame, harass, abuse, threaten or defraud users of the DocRevolution IPIDcreator, or post, upload, or distribute any content that is unlawful or otherwise inappropriate, or collect, or attempt to collect, personal information about users or third parties without their consent, or use the content on the DocRevolution IPIDcreator not uploaded by you for any commercial use;

1.8

impersonate any person or entity, falsely claim an affiliation with any person or entity, or access the DocRevolution IPIDcreator accounts of others without permission, forge another persons' digital signature, misrepresent the source, identity, or content of information transmitted via the DocRevolution IPIDcreator, or perform any other similar fraudulent activity;

1.9

hack, remove, circumvent, disable, damage or otherwise interfere with security-related features of the DocRevolution IPIDcreator or Publications, features that prevent or restrict use or copying of any content accessible through the DocRevolution IPIDcreator, or features that enforce limitations on the use of the DocRevolution IPIDcreator or Publications, or intentionally interfere with or damage operation of the DocRevolution IPIDcreator or any user's enjoyment of the Publications, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;

1.10

reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the DocRevolution IPIDcreator or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation;

1.11

modify, adapt, translate or create derivative works based upon the DocRevolution IPIDcreator or any part thereof, except and only to the extent that such activity is expressly permitted by these Terms or applicable law notwithstanding this limitation; or

1.12

remove, obscure, block, hide or otherwise alter the display of any advertising (or any parts or aspects thereof) DocRevolution brand elements, including logos, trademarks, service marks or other Materials displayed by DocRevolution in connection with the DocRevolution Service in any manner whatsoever, regardless of your use of the embedding functionality of the DocRevolution Service to display authorized content on your or other third-party sites.

H.1

It is DocRevolution's policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act or similar legislation worldwide.

H.2

If we receive notice that your Publication(s) (or some of it) infringes third-party rights, we will take down your uploaded Publication, if the notice in our responsible opinion is sufficiently substantiated. We may take down your Publication without becoming liable for any losses or damage that you may sustain due to the take down.

H.3

If we take your uploaded Publication down, we will inform you of the take down and grant you the opportunity to prove that you have complied with section F.4 By uploading your....

H.4

If we are satisfied that you have complied with section F.4 By uploading your..., we may allow you to upload the Publication again, but we are not obliged to do so unless all disputed content has been removed.

4.1

Any subsequent upload of the infringing content in a Publication taken down by us, or upload in a new Publication without our permission will be considered a material breach of these Terms.

4.2

Any costs associated with handling a takedown notice shall be borne by you, and you shall indemnify us and hold us harmless.

H.5

DocRevolution may without notice terminate any User's access to the DocRevolution IPIDcreator if that User is determined by DocRevolution to be a "repeat infringer".

5.1

A repeat infringer is a User who has been notified by DocRevolution of infringing activity violations more than twice, or who has had Publications removed from the DocRevolution IPIDcreator more than twice.

H.6

We may introduce technologies that are aimed at detecting copyright infringements in connection with uploads and other measures to ensure that publications are only uploaded in accordance with the regulations in these Terms and applicable copyright laws. Such technologies shall not relieve you of your responsibilities for copyright infringements.

I.1

As part of the DocRevolution IPIDcreator, DocRevolution may as a service provide application protocol interfaces (the “API”) to allow you or and independent third party to integrate with the DocRevolution IPIDcreator and exchange data.

I.2

DocRevolution makes no representations or warranties whatsoever regarding any API or any quality of service available via any API.

I.3

DocRevolution may restrict usage limits:

  1. you will not modify any content accessed via that API;
  2. DocRevolution may terminate or deprecate any service or functionality available via an API at any time without notice or liability; and
  3. use of some APIs may require obtaining an API key from DocRevolution, and DocRevolution may disable any key at any time without notice or liability.

To the extent you access or otherwise use any third party API, such access may
